Citation Nr: 18156634 Decision Date: 12/10/18 Archive Date: 12/10/18 DOCKET NO. 15-18 300 DATE: December 10, 2018 ORDER The appeal of the claim for entitlement to service connection for right rotator cuff impingement syndrome and degenerative joint disease of the right shoulder (hereinafter, “right shoulder disability”) is dismissed. The appeal of the claim for entitlement to service connection for prostate cancer is dismissed. FINDING OF FACT On November 5, 2018, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran, through his authorized representative, requesting a withdrawal of the claims currently on appeal. CONCLUSIONS OF LAW The criteria for withdrawal of the appeal for entitlement to service connection for a right shoulder disability have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. The criteria for withdrawal of the appeal for entitlement to service connection for prostate cancer have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSIONS The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran withdrew his claims on appeal in a November 5, 2018 statement; thus, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the claims on appeal and they are dismissed. H.M.
