Citation Nr: 18156760 Decision Date: 12/10/18 Archive Date: 12/10/18 DOCKET NO. 15-01 480 DATE: December 10, 2018 ORDER Entitlement to a total disability rating based on individual unemployability due to service-connected disability (TDIU) prior to April 12, 2013, is dismissed. FINDING OF FACT 1. In an October 2018 rating decision, the Veteran’s claim for TDIU was granted effective April 12, 2013. 2. In November 2018, prior to the promulgation of a decision on the appeal, the Veteran expressed through counsel, a desire to withdraw the issue of entitlement to TDIU prior to April 12, 2013. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105 (b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2018). REASONS AND BASES FOR FINDINGS AND CONCLUSION The Veteran served on active duty in the United States Army from July 1969 to February 1971. This matter comes before the Board of Veterans Appeals (Board) on remand from an August 28, 2018 BVA decision. The Board notes that in October 2018, the Review Officer in the Department of Veterans Affairs (VA) Regional Office (RO), granted the Veteran’s claim for entitlement a TDIU since April 12, 2013. As this action represents a full grant of benefits, this claim is no longer in appellate status. 1. The appeal as to the issue of entitlement to TDIU The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In the present case, the Veteran has withdrawn his appeal for the following claim: entitlement to TDIU prior to April 12, 2013. Thus, there remain no allegations of errors of fact or law for appellate consideration.
