Citation Nr: 18156810 Decision Date: 12/11/18 Archive Date: 12/10/18 DOCKET NO. 15-08 823 DATE: December 11, 2018 ORDER Entitlement to an initial disability rating in excess of 50 percent for posttraumatic stress disorder (PTSD) is dismissed. FINDING OF FACT In December 2018, the Veteran submitted a statement which documents his satisfaction with a July 2018 Board decision that granted an initial 100 percent disability rating for PTSD, as well as his request to withdraw his appeal regarding his claim for a higher initial disability rating for PTSD. CONCLUSION OF LAW The criteria for withdrawal of the Veteran’s appeal have been met. 38 U.S.C. § 7105(b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from November 1965 to September 1967. During the pendency of the appeal, a July 2018 Board decision granted an initial 100 percent disability rating for PTSD; this decision was implemented by a subsequent December 2018 rating decision. Entitlement to an initial disability rating in excess of 50 percent for posttraumatic stress disorder (PTSD). The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105 (2012). An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204 (2017). Withdrawal may be made by the appellant or by his or her authorized representative. Id. In December 2018, the Veteran submitted a statement which documents his satisfaction with a July 2018 Board decision that granted an initial 100 percent disability rating for PTSD as well as his request to withdraw his appeal regarding his claim regarding the initial disability rating for PTSD. Given the Veteran’s request, there remain no allegations of errors of fact or law for appellate consideration with respect to his claim regarding the initial rating assigned for his service-connected PTSD. Accordingly, the Board does not have jurisdiction to review the matter, and it is dismissed. A. P. SIMPSON Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD D. Chad Johnson, Counsel
