FINDING OF FACT In November 2018, the Veteran submitted a signed statement communicating that he wished to withdraw all issues on appeal. His statement included his name and claims file number. CONCLUSION OF LAW The criteria for withdrawal of a substantive appeal by the Veteran on the issue of entitlement to an increased rating for sinusitis have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. §§ 20.202, 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the United States Navy from July 1985 to August 1989 and from November 1989 to November 1992. This matter is before the Board of Veterans’ Appeals (Board) on appeal from a December 2014 rating decision issued by a Department of Veterans Affairs (VA) Regional Office (RO). Withdrawal An appeal consists of a timely filed notice of disagreement in writing, and after a statement of the case has been furnished, a timely filed substantive appeal. 38 U.S.C. § 7105(a); 38 C.F.R. § 20.200. Under 38 U.S.C. § 7105, the Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. Further, a substantive appeal may be withdrawn in writing at any time before the Board promulgates a decision. 38 C.F.R. §§ 20.202, 20.204(b). In November 2018, the Veteran submitted a statement that he wished to withdraw all issues on appeal. His statement included his name and claims file number. Therefore, the Veteran has satisfied the requirements of 38 C.F.R. § 20.204(b) in withdrawing his appeal with respect to the issues of increased rating for sinusitis. There remain no allegations of error of fact or law for appellate consideration on these issues, and the Board does not have further jurisdiction. WILLIAM H.
