Citation Nr: 18157252 Decision Date: 12/12/18 Archive Date: 12/12/18 DOCKET NO. 17-47 423 DATE: December 12, 2018 ORDER The petition to reopen a previously denied claim for service connection for a left knee disability is dismissed. FINDING OF FACT In October 2018, the Veteran notified the Board that he wished to withdraw the appeal for the issue of whether new and material evidence has been received to reopen the claim for service connection for a left knee disability. CONCLUSION OF LAW The criteria for the withdrawal of the appeal of whether new and material evidence has been received to reopen the claim for service connection for a left knee disability by the Veteran have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran had active service from August 1952 to August 1954. This matter comes before the Board of Veterans Appeals (Board) on appeal from a rating decision by a Department of Veterans’ Affairs (VA) Regional Office (RO). The Board may dismiss any appeal that fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the Veteran or by his or her authorized representative. Id. In an October 2018 correspondence, prior to the promulgation of a Board decision, the Veteran indicated that he wished to withdraw his appeal of the issue of whether new and material evidence has been received to reopen the claim seeking entitlement to service connection for a left knee disability. This withdrawal is in writing and have been associated with the Veteran’s claims file. There remain no allegations of errors of fact or law for appellate consideration. The Board does not have jurisdiction to review this claim, and it is therefore dismissed. DELYVONNE M. WHITEHEAD Acting Veterans Law Judge Board of Veterans’ Appeals ATTORNEY FOR THE BOARD C.
