Entitlement to a total disability rating based on individual unemployability (TDIU) is withdrawn. FINDINGS OF FACT 1. In January 2018, prior to the promulgation of a decision in the appeal, the Veteran withdrew his substantive appeal on the claim of entitlement to a rating in excess of 70 percent for PTSD. 2. In November 2018, prior to the promulgation of a decision in the appeal, the Veteran withdrew his substantive appeal on the claim of entitlement to a TDIU. CONCLUSIONS OF LAW 1. The criteria for withdrawal of the claim for entitlement to a rating in excess of 70 percent for PTSD have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. 2. The criteria for withdrawal of the claim for entitlement to a TDIU have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Veteran served on active duty from December 1965 to December 1968. Entitlement to a rating in excess of 70 percent for PTSD; and entitlement to a total disability rating based on individual unemployability are withdrawn The Board of Veterans’ Appeals (Board) may dismiss any appeal that fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. Id. In January 2018, the Veteran, thorough his representative, requested withdrawal of his PTSD claim, and in November 2018, the Veteran, again through his representative, requested withdrawal of “all issues on appeal,” to include his TDIU claim. Given the above written request, there remains no allegations of errors of fact or law for appellate consideration. The Board does not have jurisdiction to review his appeal as to these two issues, and the Veteran’s claims must be dismissed. (Continued on the next page) A. C.
