Citation Nr: 18157515 Decision Date: 12/12/18 Archive Date: 12/12/18 DOCKET NO. 17-04 794 DATE: December 12, 2018 REMANDED Entitlement to service connection for the cause of the Veteran's death is remanded. REASONS FOR REMAND The Veteran served on active duty from November 1981 to November 1984. The Appellant appeals a July 2016 rating decision by the Agency of Original Jurisdiction (AOJ) denying service connection for the cause of the Veteran’s death. Subsequent to the October 2016 Statement of the Case (SOC), new medical and lay evidence was associated with the claims file. In March 2018, the Appellant submitted correspondence requesting that her appeal be remanded to the AOJ for review of this new evidence in the first instance. In accordance with the Appellant’s request, the Board will remand for the AOJ to consider the evidence in the first instance. The matter is REMANDED for the following action: 1. After undertaking any additional development deemed necessary, readjudicate the issue on appeal. The AOJ should consider all evidence added to the record since the most recent SOC. If the decision is adverse to the Appellant, issue a Supplemental SOC and allow the appropriate time for response. Then return the claim to the Board. DONNIE R.
