FINDING OF FACT Prior to the promulgation of a decision on the appeal, the Veteran withdrew his claim for entitlement to special monthly compensation at a higher level of aid and attendance. CONCLUSION OF LAW The criteria for withdrawal of the appeal for the issue of entitlement to special monthly compensation at a higher level of aid and attendance have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from October 1948 to October 1949, and from October 1950 to November 1951, to include service in Korea. His awards and decorations include a Combat Infantryman Badge and the Purple Heart Medal with one oak leaf cluster, among others. This matter comes before the Board of Veterans’ Appeals (Board) from an August 2016 rating decision of the Department of Veterans Affairs Regional Office. In a December 2018 statement, the Veteran withdrew his appeal for entitlement to special monthly compensation at a higher level of aid and attendance and cancelled a scheduled videoconference hearing before the undersigned. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. A substantive appeal may be withdrawn by a veteran or his authorized representative in writing or at a hearing at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. As there remains no allegation of error of fact or law for the Board to address with respect to this issue, the Board does not have jurisdiction over the issue and dismissal is warranted.
