FINDING OF FACT In a November 2018 statement, the Veteran wrote that he wished to withdraw his appeal of the denial of service connection for squamous cell carcinoma. CONCLUSION OF LAW The criteria for withdrawal of the appeal of the denial of service connection for squamous cell carcinoma by the appellant have been met. 38 U.S.C. § 7105(b)(2), (d)(5) (2012); 38 C.F.R. § 20.204 (2017). REASONS AND BASES FOR FINDING AND CONCLUSION 1. Service connection for squamous cell carcinoma The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.204. In a November 2018 statement, the Veteran wrote that he wished to withdraw his appeal of the denial of service connection for squamous cell carcinoma. He wrote that he was withdrawing the issue because he was happy with the “100 percent permanent and total award.” A review of the record shows that the Veteran has been granted compensation for total disability based on individual unemployability beginning June 2011. The Veteran was explicit and unambiguous as to his desire to withdraw and demonstrated an understanding of his current level of compensation and the consequences of withdrawal. See Acree v. O’Rourke, 891 F. 3d 1009 (Fed. Cir. 2018). There remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal of the denial of service connection for squamous cell carcinoma, and it is dismissed. KRISTI L.
