Citation Nr: 18157979 Decision Date: 12/14/18 Archive Date: 12/13/18 DOCKET NO. 15-32 302 DATE: December 14, 2018 REMANDED Entitlement to a rating in excess of 70 percent for the service-connected psychotic disorder is remanded. Entitlement to an effective date prior to December 21, 2012, for the 70 percent rating for the service-connected psychotic disorder is remanded. REASONS FOR REMAND The Veteran had active service from September 1973 to September 1995. This case comes before the Board of Veterans' Appeals (Board) on appeal of May 2010 and November 2013 rating decisions by the Department of Veterans Affairs (VA) Regional Office (RO) in Jackson, Mississippi. In December 2015, the Board granted entitlement to total disability rating based on individual unemployability (TDIU) for the entire pendency of the appeal for that claim, and remanded the issues of entitlement to service connection for sleep apnea, entitlement to a rating in excess of 70 percent for the service-connected psychotic disorder, and entitlement to an effective date prior to December 21, 2012, for the 70 percent rating for the service-connected psychotic disorder, for additional development and readjudication by the RO. In March 2018, the Board again remanded the issue of entitlement to service connection for sleep apnea, noting that, of the three claims remanded in December 2015, only the sleep apnea claim had been readjudicated by the RO and recertified to the Board, and that a future Board decision addressing the remaining appealed issues would be issued at a future point, if necessary. However, the issues of entitlement to a rating in excess of 70 percent for the service-connected psychotic disorder and entitlement to an effective date prior to December 21, 2012, for the 70 percent rating for the service-connected psychotic disorder have not yet been readjudicated by the RO. As such, these claims must be remanded in order for the RO to readjudicate the claims. The matters are REMANDED for the following action: (Continued on the next page)   Readjudicate the Veteran’s claims for entitlement to a rating in excess of 70 percent for the service-connected psychotic disorder and entitlement to an effective date prior to December 21, 2012, for the 70 percent rating for the service-connected psychotic disorder. If any benefit on appeal remains denied, issue a supplemental statement of the case. Thereafter, the case should be returned to the Board, if in order. M.
