Citation Nr: 18158011 Decision Date: 12/14/18 Archive Date: 12/13/18 DOCKET NO. 17-06 570 DATE: December 14, 2018 REMANDED Entitlement to an initial disability rating exceeding 10 percent for a left knee disability is remanded. REASONS FOR REMAND The Veteran served on active duty from January 1986 to August 1990. This appeal comes to the Board of Veterans’ Appeals (Board) from a December 2014 rating decision by a Department of Veterans Affairs (VA) Regional Office (RO). Since the last adjudication of this matter in the January 2017 Statement of the Case, the Agency of Original Jurisdiction (AOJ) obtained additional relevant evidence including a March 2017 VA examination of the Veteran’s knees. However, the AOJ did not readjudicate the Veteran’s claim for entitlement to an initial disability rating exceeding 10 percent for his left knee based on the totality of the evidence including the latest VA examination. On remand, the AOJ should readjudicate the matter in the first instance and provide the Veteran and his representative with a Supplemental Statement of the Case.   The matter is REMANDED for the following action: A Supplemental Statement of the Case must be provided to the Veteran and current representatives. After the Veteran has had adequate opportunity to respond, the appeal must be returned to the Board for appellate review.
