Citation Nr: 18158212 Decision Date: 12/14/18 Archive Date: 12/14/18 DOCKET NO. 16-35 944A DATE: December 14, 2018 REMANDED Entitlement to clothing allowances for the 2016 calendar year for knee braces, incontinence pads (pull-ups/adult diapers), and creams/medications is remanded. REASONS FOR REMAND The Veteran had active duty service from June 1967 to June 1969. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from an April 2016 letter of determination by a Department of Veterans Affairs (VA) Medical Center. The Veteran testified at a Board hearing before the undersigned Veterans Law Judge in July 2017. The Board reflects that the claims for clothing allowances for knee braces, incontinence pads, and creams/medications for the 2014 and 2015 calendar years are the subject of a separate appeal in which the Veteran had a hearing before another Veterans Law Judge in August 2015. Those claims were remanded in a May 2018 Board remand for additional development. As this claim is intertwined with those claims for clothing allowances, the Board finds that this claim must also be remanded at this time as intertwined with those remanded claims. See Henderson v. West, 12 Vet. App. 11, 20 (1998); Harris v. Derwinski, 1 Vet. App. 180, 183 (1991). The matter is REMANDED for the following action: 1. The AOJ should ensure substantial compliance with the May 2018 Board remand directives. 2. Following completion of the above, as well as any further development of this claim as appropriate, the AOJ should review the claims file and readjudicate the Veteran’s claim of entitlement to clothing allowances for the 2016 calendar year for knee braces, incontinence pads (pull-ups/adult diapers), and creams/medications If the benefits sought on appeal remain denied, the Veteran and his representative should be furnished a supplemental statement of the case and given the opportunity to respond thereto before the case is returned to the Board.
