Citation Nr: 18158312 Decision Date: 12/14/18 Archive Date: 12/14/18 DOCKET NO. 17-00 024 DATE: December 14, 2018 REMANDED Entitlement to an evaluation in excess of 10 percent disabling for service-connected left knee strain with degenerative joint disease (DJD) is remanded. Entitlement to an evaluation in excess of 10 percent disabling for service-connected right knee strain with degenerative joint disease (DJD) is remanded. REASONS FOR REMAND The Veteran served on active duty with the United States Army from July 1967 to July 1969. The Board recognizes that the Veteran’s service-connected bilateral knee conditions were last evaluated in an October 2018 VA examination. A copy of the examination report has been associated with the claims file. However, review of the record fails to show that a post-examination supplemental statement of the case has ever been issued. Accordingly, this matter is remanded to the Agency of Original Jurisdiction (AOJ) for issuance of a supplemental statement of the case. VA will notify the Veteran if further action is required. Therefore, this matter is REMANDED for the following action: The AOJ should review the claims file, to include the October 2018 VA examination findings and re-adjudicate the Veteran’s claims. If the benefits sought remain denied, supply the Veteran and his representative with an SSOC and allow an appropriate period of time for response. Thereafter, the claims folder should be returned to the Board for further appellate review, if otherwise in order. The Veteran has the right to submit additional evidence and argument on the matter or matters the Board has remanded. Kutscherousky v. West, 12 Vet. App. 369 (1999). This claim must be afforded expeditious treatment. The law requires that all claims that are remanded by the Board of Veterans’ Appeals or by the United States Court of Appeals for Veterans Claims for additional development or other appropriate action must be handled in an expeditious manner.
