Citation Nr: 18158640 Decision Date: 12/18/18 Archive Date: 12/17/18 DOCKET NO. 17-00 343 DATE: December 18, 2018 REMANDED Entitlement to a total disability rating based on individual unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran had active service from December 1964 to December 1968. 1. Entitlement to a TDIU is remanded. The record indicates that the RO undertook development after the most recent adjudication of the matter, including contacting Social Security Administration (SSA) and the Veteran’s previous employer for information and scheduling the Veteran for a VA examination. The Board finds the issue must be remanded for consideration of the foregoing evidence by the originating agency. Additionally, a VA examination was scheduled in May 2017 and the Veteran failed to report. There is no notification within the claims file indicating the Veteran was provided notice of the examination and subsequently documentation reflects that the Veteran failed to report. The AOJ should again schedule a VA examination. The Veteran is on notice that when entitlement to a benefit cannot be established without a current VA examination, and a claimant, without good cause, fails to report for such examination in conjunction with an original compensation claim, the claim shall be rated based on the evidence of record. 38 C.F.R. § 3.655. The matter is REMANDED for the following action: Readjudicate the issue of entitlement to a TDIU with consideration of all evidence associated with the record since the claim was most recently addressed by the AOJ. Then, after conducting any further development deemed warranted, including a VA examination, readjudicate the issue on appeal. If any benefit sought on appeal remains denied, furnish the Veteran and his representative with a Supplemental Statement of the Case and afford them the opportunity to respond before the file is returned to the Board for further consideration.
