FINDING OF FACT By November 2018 letter, the Veteran, through his representative, withdrew his appeal for entitlement to service connection for diabetes mellitus, type II, as secondary to steroid treatment. CONCLUSION OF LAW The criteria for withdrawal of the appeal for entitlement to service connection for diabetes mellitus, type II, as secondary to steroid treatment have been met. 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Veteran had active service from February 1956 through October 1977. VA regulations provide that a Veteran's appeal may be withdrawn as to any or all issues involved in the appeal. 38 C.F.R. § 20.204(a). They also include guidelines related to the form and content of a withdrawal. Section 20.204(b)(1) provides that, except for appeals withdrawn on the record at a hearing, appeal withdrawals must be in writing. They must include the name of the veteran, the name of the claimant or appellant if other than the veteran (e.g., a veteran's survivor, a guardian, or a fiduciary appointed to receive VA benefits on an individual's behalf), the applicable VA file number, and a statement that the appeal is withdrawn. If the appeal involves multiple issues, the withdrawal must specify that the appeal is withdrawn in its entirety, or list the issue(s) withdrawn from the appeal. Acree v. O'Rourke, 891 F.3d 1009, 1013, n. 2 (Fed. Cir. 2018). The Veteran, through his authorized representative, stated in writing that he would like to withdraw his claim for diabetes mellitus, type II, secondary to steroid treatment that is currently on appeal. The letter properly identified the Veteran and the claim number in accordance with 38 C.F.R. § 20.204. As such, there remain no allegations of error of fact or law for appellate consideration as to this issue. See 38 C.F.R. § 20.202. Accordingly, the appeal of the issue of service connection for diabetes mellitus, type II, as secondary to steroid treatment is dismissed. Eric S.
