Citation Nr: 18158718 Decision Date: 12/18/18 Archive Date: 12/17/18 DOCKET NO. 14-01 349 DATE: December 18, 2018 REMANDED ISSUES The issue of entitlement to an initial evaluation for posttraumatic stress disorder (PTSD) in excess of 50 percent is remanded. The issue of entitlement to a total rating based on individual unemployability due to service-connected disability (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active duty from May 1968 to December 1969. The Board remanded the issues on appeal in November 2017. On a November 2017 VA Form 21-8940, the Veteran noted treatment from Dr. Chad Bates and Dr. John F. Berry for his service-connected disabilities. Private treatment records submitted by the Veteran in November 2017 include records from Dr. Bates dated in 2015 and 2016. However, VA treatment records reflect treatment by Dr. Bates in 2014. The private treatment records also refer to a 2012 appointment with Dr. Berry. However, the Veteran's eFolders contain no records from Dr. Berry. Thus, it appears that there are additional outstanding relevant private treatment records. A remand is required to allow VA to obtain authorization and request these records. The matters are REMANDED for the following action: 1. Ask the Veteran to complete a VA Form 21-4142 for Dr. Chad Bates and Dr. John F. Berry. Make two requests for the authorized records from Dr. Chad Bates and Dr. John F. Berry, unless it is clear after the first request that a second request would be futile. 2 After the above development, and any additionally indicated development on the TDIU claim, has been completed, readjudicate the issues on appeal.
