Citation Nr: 18112043 Decision Date: 06/18/18 Archive Date: 06/18/18 DOCKET NO. 15-04 799 DATE: June 18, 2018 REMANDED Entitlement to a rating in excess of 10 percent for residuals of a right (major) elbow fracture is remanded. Entitlement to a rating in excess of 10 percent for residuals of a left knee injury is remanded. Entitlement to a rating in excess of 10 percent for residuals of a postoperative right knee injury is remanded. REASONS FOR REMAND The Veteran had active duty from April 1968 to February 1971. He is appealing for additional compensation for his service connected right elbow and right and left knee disabilities, which are each currently rated as 10 percent disabling. His most recent VA examination was in October 2011, which was almost 7 years ago. During his hearing before the undersigned in December 2015, he indicated that he has received treatment from VA and from Drs. Rhodes and Beck. He also indicated that his right elbow disability has become worse, and that he drops things with his right hand and feels that his service connected disability is affecting the nerves throughout his arm, down to his wrist and into his hand. Regarding his knees, he indicated that sometimes they give out on him. In light of the evidence, the length of time since the last VA examinations, and Correia v. McDonald, 28 Vet. App. 158 (2016), the Board finds that additional development as indicated below is necessary. The matters are REMANDED for the following action: 1. Make arrangements to obtain any additional records which are relevant to the claims, including any relevant and outstanding VA and private medical records of treatment, including from Dr. Rhodes and Beck, dating from August 2010 to present. 2. After the above development is completed, schedule the Veteran for an appropriate VA examination to determine the nature, extent, and severity of his service-connected right elbow disability. The claims folder should be made available to the examiner. All indicated tests should be performed, and the results should be reported in detail. The examiner is requested to delineate all symptomatology associated with, and the current severity of, the service-connected right elbow disability, and to identify and describe all limitation of function due to the disability. The examiner should: (a.) Identify any neurological manifestations and opine as to whether it is at least as likely as not that they are (i) part of, (ii) caused by or (iii) aggravated by the service connected elbow disability. (Please address (i), (ii) and (iii) in the report). Please consider and discuss as necessary the Veteran’s reports that he drops things with his right hand and that it “goes to sleep” sometimes and 2012 reports of Dr. Rhodes diagnosing right ulnar tunnel syndrome and “TFC tear” with a history of right carpal tunnel release. (b.) Please test and record range of motion of the Veteran's left and right elbow with active motion, passive motion, weight-bearing, and non-weight-bearing, If the examiner is unable to conduct the required testing, he or she should clearly explain why that is so. (c.) The examiner should also express an opinion concerning whether there would be additional functional impairment on repeated use or during flare-ups. The examiner should assess or estimate any additional functional impairment on repeated use or during flare-ups in terms of the degree of additional range of motion loss of the right elbow. 3. After the development in #1 is completed, schedule the Veteran for an appropriate VA examination to determine the nature, extent, and severity of his service-connected right and left knee disabilities. The claims folder should be made available to the examiner. All indicated tests should be performed, and the results should be reported in detail. The examiner is requested to delineate all symptomatology associated with, and the current severity of, the service-connected right and left knee disabilities, and to identify and describe all limitation of function due to the disability. The examiner should: (a.) Test and record range of motion of the Veteran’s left and right knees with active motion, passive motion, weight-bearing, and non-weight-bearing. If the examiner is unable to conduct the required testing, he or she should clearly explain why that is so. (b.) The examiner should also express an opinion concerning whether there would be additional functional impairment on repeated use or during flare-ups. The examiner should assess or estimate any additional functional impairment on repeated use or during flare-ups in terms of the degree of additional range of motion loss of the left and right knees.
