Citation Nr: 18112486 Decision Date: 06/19/18 Archive Date: 06/19/18 DOCKET NO. 16-39 652 DATE: June 19, 2018 REMANDED The claim for entitlement to service connection for a left upper extremity condition is remanded. The claim for entitlement to service connection for a clavicle condition is remanded. The claim for entitlement to service connection for a left lower extremity condition is remanded. The claim for entitlement to service connection for a head condition is remanded. REASONS FOR REMAND The Veteran served on active duty from March 1971 to August 1972. This matter is on appeal from an August 2015 rating decision. The claims for entitlement to service connection for a left upper extremity condition; a clavicle condition; a left lower extremity condition; and a head condition are remanded. VA is obligated to provide a medical examination when the record contains competent evidence that a claimant has a current disability or symptoms of a current disability, the record indicates that a current disability or symptoms of a current disability may be associated with active service, and the record does not contain sufficient information to make a decision on the claim. McLendon v. Nicholson, 20 Vet. App. 79, 81-83 (2006). See also 38 C.F.R. § 3.159(c)(4). The Veteran filed service connection claims concerning a left upper extremity condition, a clavicle condition, a left lower extremity condition, and a head condition. While the Veteran provided little detail concerning the basis of these claims, current VA treatment records indicate the Veteran has various neurologic deficits stemming from a diagnosis of meningeal tuberculosis. 1971 service treatment records indicate positive tuberculin test results. Given these facts, a VA examination is needed to determine the nature and etiology of any left upper extremity, clavicle, left lower extremity, and head conditions. The matters are REMANDED for the following action: 1. Obtain any outstanding, relevant VA treatment records and associate them with the claims file. 2. Schedule the Veteran for a VA examination to determine the nature and etiology of any diagnosed left upper extremity, left lower extremity, clavicle, and head conditions, to include any deficits of meningeal tuberculosis. Any studies, tests, and evaluations deemed necessary by the examiner should be performed. The examiner is to be provided access to the Veteran’s claims folder. Upon review of the file and examination of the Veteran, the examiner should note any diagnoses of the left upper extremity, left lower extremity, clavicle, and head and provide an opinion as to whether it is at least as likely as not (50 percent or greater possibility) that any diagnosed disabilities had its onset in service or is etiologically related to service. In providing this opinion, the examiner should discuss the relationship, if any, between 1971 service treatment records showing positive tuberculin tests and any neurologic deficits arising from the Veteran’s current diagnosis of meningeal tuberculosis. The examiner must include in the examination report rationale for any opinion expressed. If the examiner is unable to provide opinion without resort to speculation, the examiner should explain why a response would be speculative. 3. After completing the actions detailed above, readjudicate the claims. If any claim remains denied, a supplemental statement of the case must be provided to the Veteran. After the Veteran has had an adequate opportunity to respond, the appeal must be returned to the Board for appellate review. T.
