Citation Nr: 18138489 Decision Date: 09/25/18 Archive Date: 09/25/18 DOCKET NO. 15-19 161 DATE: September 25, 2018 ORDER Entitlement to an initial compensable rating for bilateral hearing loss is dismissed Entitlement to service connection for bilateral carpal tunnel syndrome is dismissed. FINDING OF FACT 1. Through a June 2017 statement, the Veteran requested to withdraw the issues currently on appeal: an initial compensable rating for bilateral hearing loss and service connection for bilateral carpal tunnel syndrome. CONCLUSION OF LAW 1. The criteria for withdrawal of the issues on appeal have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served in the Army from September 1971 through September 1992. There were nine issues on appealed to the Board. Through a rating decision dated May 2017, service connection was granted for the following issues: right knee arthritis, left knee arthritis, migraines, cervical spine issues, right upper extremity radiculopathy, lumbar spine issues, and lower extremity radiculopathy. A concurrently issued supplemental statement of the case addressed the remaining issues on appeal: an initial compensable rating for bilateral hearing loss and service connection for bilateral carpal tunnel syndrome. The Board may dismiss any appeal which fails to allege a specific error of fact or law in the determination being appealed. See 38 U.S.C. § 7105. An appellant or an authorized representative may withdraw any or all issues involved in an appeal at any time before the Board promulgates a decision. See 38 C.F.R. § 20.204. In a June 2017 statement, the Veteran, requested to withdraw his claim for service connection for bilateral carpal tunnel syndrome and for an increase rating for bilateral hearing loss. The Veteran was scheduled for a hearing in connection to these claims and he did not appear at that hearing. Therefore, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review this matter and it is dismissed. R.
