Citation Nr: 19160489 Decision Date: 08/05/19 Archive Date: 08/05/19 DOCKET NO. 1900313 ORDER As the claim was granted in an April 2019 decision by the Committee of Waivers and Compromises, the Veteran’s request for a waiver of indebtedness in the amount of $3,660.00 is dismissed as moot. FINDING OF FACT An April 2019 administrative decision granted a waiver of indebtedness in the amount of $3660.00; there remains no controversy for the appellate consideration. CONCLUSION OF LAW As the claim for waiver of indebtedness in the amount of $3,660.00 has been granted in full by the VA Committee on Waivers and Compromises, the Board has no jurisdiction to adjudicate the merits of the claim at this time. 38 U.S.C. § 7105(d)(5). REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran appealed an Agency denial of a waiver of indebtedness in the amount of $3,660.00. During the pendency of the appeal, on April 22, 2019, the VA Committee of Waivers and Compromises (Committee) granted in full the benefit sought by the Veteran. Under 38 U.S.C. § 7105(d)(5), the Board may dismiss any appeal that fails to allege specific error of fact or law in the determination being appealed. As the Committee granted in full the benefit sought by the Veteran, there is no remaining allegation of error of fact or law for appellate consideration. Therefore, the Board does not have jurisdiction over the appeal as there remains no controversy for appellate consideration. Accordingly, the appeal it is dismissed as moot. C.A.
