REASONS FOR REMAND The Veteran served on active duty in the Army from October 1977 to October 1999. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from a September 2016 rating decision by the Waco, Texas, Regional Office (RO) of the United States Department of Veterans Affairs (VA). This issue was previously before the Board in July 2019 at which time it was remanded for additional development. The Board directed that an opinion be obtained as to the nature and etiology of the Veteran’s claimed penis disability, to include erectile dysfunction. The Board specifically noted the Veteran’s contention that the issue is psychological in nature; related to an incident in which he lost control of his bowels during intercourse with his wife. In its remand instructions, the Board directed that the Veteran was to be scheduled for a VA examination and an opinion as to the etiology of any diagnosed disability was to be obtained, to include as due to a service-connected disorder, to include fecal leakage, residuals of hemorrhoidectomy and major depressive disorder. A review of the opinion provided reveals the examiner did not discuss whether the Veteran’s penis disability, to include erectile dysfunction, was related to any resulting psychological issues/factors due to his service-connected fecal leakage disability and/or service-connected major depressive disorder. The Board finds the September 2019 VA examination, opinions and addendum opinions are inadequate for adjudication purposes. On remand, a new examination should be scheduled and an opinion as to the etiology of the Veteran’s claimed penis disability, to include erectile dysfunction as secondary to a service-connected disability should be obtained. Stegall v. West, 11 Vet. App. 268, 271 (1998). The matters are REMANDED for the following action: 1. Schedule the Veteran for an examination, to include a mental disorders examination if needed, by an appropriate examiner to determine the nature and etiology of any penis disability, to include erectile dysfunction. The examiner must opine whether it is at least as likely as not (50 percent or greater probability) that any diagnosed erectile dysfunction is either caused or aggravated by a service-connected disability – specifically fecal leakage, residuals of hemorrhoidectomy, and/or major depressive disorder to including psychological effects/impact any of these disabilities may have on the Veteran’s sexual functioning. A full and complete rationale for all opinions expressed is required. 2. Then, readjudicate the remanded issue. If the benefit sought remains denied, the Veteran and his representative should be provided with a supplemental statement of the case.
