Citation Nr: 20004358 Decision Date: 01/17/20 Archive Date: 01/17/20 DOCKET NO. 18-30 549 DATE: January 17, 2020 REMANDED Entitlement to a compensable evaluation for service-connected history, fracture of anterior maxillary and labial cortex with teeth #8,9,10,23,26 due to trauma, is remanded. REASONS FOR REMAND The Veteran served on active duty from December 1983 to December 1987. In November 2019, the Veteran testified under oath at a hearing before the undersigned Veterans Law Judge. A transcript of the hearing is of record. At the hearing, the Veteran gave detailed testimony regarding the current status of his dental prostheses. To the extent that the Veteran was making a request for treatment, the Board reiterates that since March 24, 2015, VA may no longer recognized informal claims. If the Veteran is interested in filing a claim, he must do so on the specified form prescribed by the Secretary. Entitlement to a compensable evaluation for service-connected history, fracture of anterior maxillary and labial cortex with teeth #8,9,10,23,26 due to trauma, is remanded. It was noted at the November 2019 hearing that there may be outstanding VA treatment records relating to the disability on appeal. Upon remand, the Board asks that these and any outstanding treatment records be obtained. After the records are obtained, the Board asks that the Veteran be scheduled for a new VA examination to determine the current severity of his service-connected disability. The matter is REMANDED for the following action: 1. After securing any necessary consent forms from the Veteran, obtain any outstanding treatment records, to include any VA and/or private treatment records, pertaining to the issue on appeal. All efforts should be documented in the claim file. If any records could not be obtained, this should be noted in the claim file. 2. Upon completion of the above, schedule the Veteran for a VA examination to address the current severity of his service-connected disability. The examiner is asked to address other impairments relating to the service-connected disability on appeal. The VA examiner should be given access to the claim file. The examiner should state that a review of the claim file was completed. The examiner must provide a comprehensive report including complete rationales for all opinions and conclusions reached, citing the objective medical findings leading to the conclusions. A detailed rationale is requested for all opinions provided. 3. If upon completion of the above action the issue is denied, the case should be returned to the Board after compliance with appellate procedures. E. I. VELEZ Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board K. Foster, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided.
