Citation Nr: 20004866 Decision Date: 01/22/20 Archive Date: 01/21/20 DOCKET NO. 19-03 302 DATE: January 22, 2020 REMANDED Entitlement to a total disability rating based on individual unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active duty from August 1982 to July 1987. He served honorably in the U.S. Army, including service in Germany. The Board thanks the Veteran for his service to our country. Entitlement to a TDIU is remanded. A remand is warranted as the Veteran’s TDIU claim is inextricably intertwined with a claim for increased ratings for trochanteric bursitis of the left and right hips. The Veteran is currently service connected for trochanteric bursitis of the left and right hips. A February 2019 Board decision denied entitlement to ratings in excess of 10 percent for these disabilities. The Veteran appealed the decision to the United States Court of Appeals for Veterans Claims (Court). In a December 2019 Order granting a December 2019 Joint Motion for Remand, the Court vacated and remanded the February 2019 Board decision. As the issue of TDIU is inextricably intertwined with the issue of increased ratings for trochanteric bursitis of the left and right hips, a remand is necessary. The matters are REMANDED for the following action: Please hold the appeal pending adjudication of the Veteran’s claim for increased ratings for trochanteric bursitis of the left and right hips. M. C. GRAHAM Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board M. Vashaw, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential, and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
