Citation Nr: 20006983 Decision Date: 01/28/20 Archive Date: 01/28/20 DOCKET NO. 07-39 436 DATE: January 28, 2020 REMANDED Entitlement to service connection for an acquired psychiatric disorder, to include posttraumatic stress disorder (PTSD), schizotypal personality and psychosis is remanded. REASONS FOR REMAND The Veteran had active military service from August 1972 to August 1974. This matter was previously before the Board of Veterans’ Appeals (Board) in January 2018 and was remanded for additional development. There was not substantial compliance with the Board’s directives, and remand is again required. Pursuant to the Board’s remand instructions, the agency of original jurisdiction (AOJ) requested authorization from the Veteran to obtain outstanding records. (See Department of Veterans Affairs (VA) September 6, 2018 letter to Veteran). In October 2018, the Veteran submitted a General Release For Medical Provider Information to the VA (General Release) that listed VA and private providers. In November 2018, VA’s Private Medical Records Retrieval Center rejected the Veteran’s request because he listed a non-private provider. While the Veteran listed a VA provider on the release, he also listed private providers from whom he had received treatment. The Veteran requested that records be obtained from the following private providers: A. T. W., LCSW, from 2015 to June 2016; Dr. S. M. E., from May 2011 to June 2011; Dr. E. L. W., from May 2009 to June 2010 and from June 2010 to “unknown”; and Dr. V. W., from January 2005 to “unknown.” All of these providers are located in Tuscaloosa, Alabama. VA has not request records from these private providers and must do so on remand. The matters are REMANDED for the following action: The AOJ should refer to the October 2018 General Release and request private treatment records from: A. T. W., LCSW, from 2015 to June 2016; Dr. S. M. E., from May 2011 to June 2011; Dr. E. L. W., from May 2009 to June 2010 and from June 2010 to “unknown”; and Dr. V. W., from January 2005 to “unknown” (all providers are located in Tuscaloosa, Alabama), following proper VA procedures. If necessary, updated release forms should be requested from the Veteran. A. C.
