Citation Nr: 20007403 Decision Date: 01/30/20 Archive Date: 01/29/20 DOCKET NO. 17-33 109 DATE: January 30, 2020 ORDER The appeal on whether a rating reduction from 60 percent to noncompensable, effective September 1, 2014, for bilateral hearing loss was proper is dismissed. FINDING OF FACT On June 12, 2019, prior to the promulgation of a decision on this appeal, the Board received notification from the Veteran that he would like to withdraw his appeal. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from November 1967 to November 1970. This matter is before the Board of Veterans’ Appeals (Board) on appeal from a June 2014 rating decision issued by a Department of Veterans Affairs (VA) Regional Office (RO). A substantive appeal may be withdrawn in writing at any time before the Board promulgates a decision or may be withdrawn on the record at a hearing. 38 C.F.R. §§ 20.202, 20.204(b). Withdrawal may be made by the Veteran or by his or her authorized representative. 38 C.F.R. § 20.204. In this case, the Veteran withdrew his claim to determine whether a rating reduction from 60 percent to noncompensable, effective September 1, 2014, for bilateral hearing loss was proper with a June 2019 statement. As the Veteran has properly withdrawn his appeal in writing, the Board no longer has appellate jurisdiction and can take no further action on these matters. 38 C.F.R. §§ 20.204, 20.1100(b). Accordingly, the appeal on whether a rating reduction from 60 percent to noncompensable, effective September 1, 2014, for bilateral hearing loss was proper is dismissed. TANYA SMITH Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board K.
