Citation Nr: 20074009 Decision Date: 11/18/20 Archive Date: 11/18/20 DOCKET NO. 19-14 971 DATE: November 18, 2020 REMANDED Entitlement to a total disability rating based on individual unemployability (TDIU) is remanded. REASONS FOR REMAND The Veteran had active service in the Army from September 1969 to March 1972, May 1979 to May 1983, and December 1990 to September 1991. The appeal originates from a February 2018 decision of a Department of Veterans Affairs (VA) Regional Office. Entitlement to TDIU is remanded. The Veteran contends that he is unable to work due to his service-connected disabilities. See November 2017 VA 21-8940; July 2019 Correspondence. He also explicitly asserts that his TDIU claim is intertwined with service connection and increased rating claims under development by the Agency of Original Jurisdiction (AOJ). See October 2020 Rating Decision and VA Form 20-0999. As these claims may significantly impact entitlement to TDIU, adjudication of the TDIU claim must be deferred at this time.   The matter is REMANDED for the following action: Readjudicate the TDIU claim in light of decision on the service connection and increased rating claims before the AOJ. MICHAEL A. HERMAN Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board M. Alhinnawi The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
