Citation Nr: 20009916 Decision Date: 02/05/20 Archive Date: 02/05/20 DOCKET NO. 17-50 810 DATE: February 5, 2020 REMANDED Entitlement to a rating in excess of 50 percent for posttraumatic stress disorder (PTSD) is remanded. REASONS FOR REMAND The Veteran served on active duty from September 1966 to September 1971. This matter comes to the Board of Veterans’ Appeals (Board) on appeal from an August 2016 rating decision issued by a Department of Veterans Affairs (VA) Regional Office. Entitlement to a rating in excess of 50 percent for PTSD. Following the issuance of the most recent statement of the case in August 2017 and certification to the Board in January 2019, additional evidence pertaining to the Veteran’s claim for an increased rating for his PTSD was added to the file, to include VA treatment records dated from January 2016 to October 2019 and private treatment records. In December 2019, the Veteran requested that the Board remand his case to the Agency of Original Jurisdiction (AOJ) for review of such additional evidence. 38 C.F.R. § 20.1304(c). Therefore, the Board finds that a remand is necessary in order to for the AOJ to readjudicate the Veteran’s claim for an increased rating for his PTSD based on the entirety of the evidence, to include such received subsequent to the August 2017 statement of the case. The matter is REMANDED for the following action: The AOJ should readjudicate the Veteran’s claim of entitlement to a rating in excess of 50 percent for PTSD based on the entirety of the evidence, to include such received subsequent to the August 2017 statement of the case (i.e., VA treatment records dated from January 2016 to October 2019 and private treatment records). English, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential, and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
