Citation Nr: 20022032 Decision Date: 03/30/20 Archive Date: 03/30/20 DOCKET NO. 16-35 916A DATE: March 30, 2020 REMANDED A rating in excess of 50 percent for posttraumatic stress disorder (PTSD). Service connection for a left lower extremity condition. Service connection for a right lower extremity condition.   REASONS FOR REMAND The Veteran served on active duty from November 1990 to September 1991. She also had a period of active duty for training from January 1984 to April 1984. The case is on appeal from an April 2016 rating decision. In November 2019, the Veteran testified at a Board hearing. The record was held open for 30 days for the submission of additional evidence. 1. A rating in excess of 50 percent for PTSD. 2. Service connection for a left lower extremity condition. 3. Service connection for a right lower extremity condition. Other than the newly submitted evidence, additional pertinent evidence has been received and associated with the Veteran's claims file since the most recent June 2017 supplemental statement of the case (SSOC), including VA treatment records and VA examination reports dated January 2018 and January 2020. Accordingly, in January 2020, the Board sent a request letter for a waiver of initial RO consideration. The Veteran was informed that she had 45 days to submit her waiver, and that if no such waiver is received, it is assumed that the Veteran does not want the Board to decide the appeal, and the Board will remand the case to the RO for review. The 45-day window has elapsed, and the Veteran has not submitted a waiver. Thus, the Board will assume that the Veteran does want her case to be decided by the Board at this time and will remand this case to the RO for consideration. The matters are REMANDED for the following action: The RO should review the evidence of record received since the June 2017 SSOC. If any benefit sought on appeal is not granted in full, furnish the Veteran and her representative an SSOC that includes consideration of all evidence associated with the claims file since the June 2017 SSOC. Then return the case to the Board for appellate review. RYAN T. KESSEL Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board E. Gray, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
