Citation Nr: 20023020 Decision Date: 04/02/20 Archive Date: 04/02/20 DOCKET NO. 16-45 911 DATE: April 2, 2020 REMANDED An increased initial disability rating in excess of 40 percent for common variable immune deficiency (CVID).   REASONS FOR REMAND The Veteran served on active duty from July 1999 to July 2003. The case is on appeal from a September 2013 rating decision. During the appeal period, the RO issued a rating decision in July 2016 granting an initial 40 percent disability rating for the disability. The issue remains on appeal. In May 2019, the Veteran testified at a Board hearing. At the hearing, the Veteran submitted additional evidence and waived initial RO consideration. See 38 C.F.R. § 20.1304(c). An increased initial disability rating in excess of 40 percent for CVID. The Veteran’s disability is currently rated under diagnostic code (DC) 6354, chronic fatigue syndrome (CFS), of 38 C.F.R. § 4.88b. This in the schedule of ratings—infectious diseases, immune disorders and nutritional deficiencies. The Veteran contends that his disability should be rated by analogy to DC 7702, agranulocytosis, of 38 C.F.R. § 4.117, which is the schedule of ratings—hemic and lymphatic systems. At his May 2019 Board hearing, the Veteran emphasized that his disability involves multiple other symptomatology apart from fatigue, including chronic sinus infections, skin infections, yeast infections, conjunctivitis, and fevers. Board Hr’g Tr. 15. He submitted medical records supporting his testimony. The Board finds that a new VA examination is needed to fully evaluate the ongoing manifestations of his disability. The matters are REMANDED for the following action: Schedule the Veteran for all examinations necessary to determine the current severity of his CVID, including any and all respiratory, skin, eye, dental, and other manifestations. The examiner(s) should identify what symptoms/conditions are associated with CVID and provide a full description of all signs and symptoms of the Veteran’s CVID and the associated symptoms/conditions necessary to evaluate the disability under the rating criteria.
