Citation Nr: 20023095 Decision Date: 04/03/20 Archive Date: 04/03/20 DOCKET NO. 19-30 510 DATE: April 3, 2020 REMANDED The issue of service connection for a low back disorder is remanded. The issue of service connection for a cervical spine disorder is remanded. The issue of service connection for a left knee disorder is remanded. The issue of service connection for a right knee disorder is remanded. The issue of service connection for a right foot disorder is remanded. The issue of service connection for a left foot disorder is remanded. The issue of service connection for an anxiety disorder is remanded. The issue of service connection for a sleep disorder is remanded. The issue of special monthly compensation based on aid and attendance benefits is remanded. REASONS FOR REMAND The Veteran had active duty service from January 1971 to January 1973. The service treatment records show that the Veteran injured his right leg in an auto accident in January 1972. It was noted that he had bruising, pain, and swelling on the left thigh. The Veteran submitted a private medical opinion dated in October 2019 noting that the Veteran was claiming that he had low back, bilateral foot, right knee, and neck problems as a result of being an Army Paratrooper from 1971 to 1973. The Veteran noted that he had feet and right knee and neck pain in the Army, though he indicated that there was no record of this. The Veteran stated that he was in a motor vehicle accident while on leave in January 1972 and suffered injuries to the right knee and low back and neck. The private clinician noted that the Veteran had an MRI of the cervical spine done in 2010, which noted degenerative cervical spondylosis and found that this was related to his time in the Army as a paratrooper and/or the motor vehicle accident in service. Efforts should be made to obtain all relevant available post-service treatment records for the claimed disabilities. A VA medical opinion should be provided to determine the likelihood that the Veteran’s claimed disabilities are related to his military service. The issue of entitlement to special monthly compensation based on aid and attendance is inextricably intertwined the other issues being remanded, herein, and is deferred. The matters are REMANDED for the following action: 1. Obtain the Veteran’s VA treatment records for the period from February 2017 to present. 2. Ask the Veteran to sign the proper release so that VA can make efforts to obtain medical records from Dr. Steven E. Miller. The Veteran also should be asked to identify any other treatment records for the low back disorder, cervical spine disorder, bilateral knee disorder, bilateral foot disorder, anxiety disorder, and sleep disorder. 3. Schedule the Veteran for a VA examination with an appropriate clinician to determine whether any of the claimed disabilities, including the low back disorder, cervical spine disorder, bilateral knee disorder, bilateral foot disorder, anxiety disorder, and sleep disorder, is at least as likely as not related to an in-service injury or disease, including the motor vehicle accident in January 1972 and/or his duties as a paratrooper in service.
