CONCLUSION OF LAW The criteria for withdrawal of the appeal regarding the timeliness of a VA Form 9 received June 20, 2017 have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty from June 1989 to September 1992. This case comes before the Board of Veterans’ Appeals (Board) on appeal of a June 2017 decision by the Department of Veterans Affairs (VA) Regional Office (RO). The appeal of the timeliness of a VA Form 9 received June 20, 2017 is dismissed. The Board may dismiss any case over which it determines it does not have jurisdiction. 38 C.F.R. § 20.104(c). An appeal may be withdrawn as to any or all issues involved at any time before the Board promulgates a decision. 38 C.F.R. § 20.205. In a Statement in Support of Claim received in September 2019, the Veteran expressed his intent to withdraw the appeal of the timeliness of a VA form 9. The Veteran’s intent to withdraw the issue is clear and unambiguous. As there are no remaining allegations of error of fact or law for appellate consideration, the Board does not have jurisdiction, and the appeal is dismissed. A. C.
