Citation Nr: 20037066 Decision Date: 06/01/20 Archive Date: 06/01/20 DOCKET NO. 16-54 196 DATE: June 1, 2020 ORDER Entitlement to service connection for migraine headaches, to include as secondary to service-connected allergic rhinitis, has been withdrawn and is dismissed. Entitlement to service connection for an anxiety disorder, to include as secondary to a service-connected back disability, has been withdrawn and is dismissed. FINDING OF FACT In a July 2019 statement, the Veteran indicated that he wished to withdraw his appeals for entitlement to service connection for migraine headaches and anxiety disorder. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the Veteran (or his authorized representative) for entitlement to service connection for migraine headaches and anxiety disorder have been met. 38 U.S.C. § 7105(b)(2), (d)(5); 38 C.F.R. § 20.204. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the United States Navy from August 1982 to September 2003. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from November 2014 and October 2015 rating decisions by the Department of Veterans Affairs (VA) Regional Office (RO). As a preliminary matter, it is valuable to note that the Veteran has already been found to be 100 percent disabled by VA. The Veteran currently has a 100 percent combined evaluation for compensation, effective November 5, 2019. Withdrawal Under 38 U.S.C. § 7105, the Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the Veteran or by his or her authorized representative. 38 C.F.R. § 20.204. In a July 2019 statement, the Veteran indicated that he wished to withdraw his appeals for entitlement to service connection for migraine headaches and anxiety disorder. The withdrawal request has been documented in the Veteran’s claims file. The Board concludes that the Veteran has withdrawn his claims for entitlement to service connection for migraine headaches and an anxiety disorder. Hence, there remain no allegations of errors of fact or law for appellate consideration. (Continued on the next page)   Accordingly, the Board does not have jurisdiction to review these appeals and they are dismissed. John J. Crowley Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board E. VanValkenburg, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
