Citation Nr: 20038024 Decision Date: 06/03/20 Archive Date: 06/03/20 DOCKET NO. 19-01 040 DATE: June 3, 2020 ORDER The issue of whether the Veteran is competent to handle the disbursement of the Department of Veterans Affairs (VA) funds is dismissed. FINDING OF FACT In a March 2019 rating decision issued during the pendency of this appeal, the Agency of Original Jurisdiction (AOJ) determined that the Veteran is competent for VA purposes. CONCLUSION OF LAW The criteria for dismissal of the competency appeal have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION The Board may dismiss any appeal that fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. In a March 2019 rating decision issued during the pendency of this appeal, the Agency of Original Jurisdiction (AOJ) determined that the Veteran was competent for VA purposes. Because the Veteran is now deemed to be competent to handle VA funds, there remains no question of law or fact to decide; therefore, the question of competency is moot and will be dismissed. J. PARKER Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board C. Ferguson, Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
