Citation Nr: 20039926 Decision Date: 06/11/20 Archive Date: 06/11/20 DOCKET NO. 12-13 440 DATE: June 11, 2020 REMANDED Entitlement to a rating in excess of 30 percent for the service-connected total right knee replacement is remanded. Entitlement to an initial rating in excess of 30 percent for the service-connected total left knee replacement is remanded. REASONS FOR REMAND The Veteran had active service from March 1969 to November 1970 and from July 1973 to November 1991. These matters come before the Board of Veterans’ Appeal (Board) from a July 2011 rating decision by the Department of Veterans Affair (VA) Regional Office in Roanoke, Virginia. The Veteran testified before the undersigned Veterans Law Judge (VLJ) during a Central Office hearing in June 2017. A transcript of that hearing is associated with the claims file. 1. Entitlement to a rating in excess of 30 percent for the service-connected total right knee replacement is remanded. 2. Entitlement to an initial rating in excess of 30 percent for the service-connected total left knee replacement is remanded. The record indicates the Veteran was scheduled for a second total left knee replacement for some time in December 2017, during the pendency of this appeal. When he was examined in October 2019, it was noted that the surgery was performed. The Veteran also disclosed he is currently receiving physical therapy three times a week. However, none of these records are not associated with the Veteran’s claim file. Such records are necessary to assess the severity of the Veteran’s right knee replacement and left knee replacement. The matters are REMANDED for the following action: Obtain the Veteran’s complete VA or VA-contracted treatment medical records. Such should include records that pertain to the Veteran’s total left knee replacement surgery in December 2017 and those that pertain to the Veteran’s ongoing physical therapy. If it is determined that there are no VA or VA-contracted treatment records available, an inquiry should be made as to whether the Veteran receives treatment for his knees from a non-VA healthcare provider. Efforts should then be made to obtain the identified records.   In either instance, if such efforts yield negative results, a notation to that effect should be inserted in the file. The Veteran must also be informed of any unobtainable treatment medical records. MICHAEL A. HERMAN Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board S. Smith, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
