Citation Nr: 20041403 Decision Date: 06/17/20 Archive Date: 06/17/20 DOCKET NO. 14-12 908 DATE: June 17, 2020 REMANDED Entitlement to service connection for hypertension is remanded. Entitlement to service connection for periodontal disease is remanded. REASONS FOR REMAND The Veteran served on active duty from July 1965 to December 1968. The issues on appeal were previously before the Board in February 2018 and May 2020, at which time they were remanded for further development. The Board notes that in between February 2018 and May 2020, service connection was granted for glaucoma, cataract, bilateral foot peripheral neuropathy, peripheral neuropathy of the upper extremities, and erectile dysfunction. This constitutes a full grant of the benefits sought in February 2018, and the issues are not before the Board.   1. Entitlement to service connection for hypertension is remanded. 2. Entitlement to service connection for periodontal disease is remanded. A review of the record indicates the appeal was returned to the Board prematurely. As noted above, the Board remanded the issues on appeal in May 2020. As part of that remand, the Agency of Original Jurisdiction (AOJ) was to schedule examinations and readjudicate the Veteran’s claims. A May 14, 2020 letter informed the Veteran a private facility would be conducting his examinations and he would be contacted by them regarding the date, time and location of the examinations. There is no indication in the record those examinations have taken place or that the AOJ has readjudicated the Veteran’s claims. A remand by the Board confers on an appellant, as a matter of law, the right to compliance with the terms of the remand order and imposes upon VA a concomitant duty to ensure compliance with those terms. See Stegall v. West, 11 Vet. App. 268, 271 (1998). In light of the above, remand is warranted to ensure compliance with the Board’s remand directives. The matters are REMANDED for the following action: 1. If the Veteran’s examinations have not been scheduled, schedule them consistent with the May 2020 remand directives.   2. After any additional development deemed appropriate, readjudicate the issues on appeal. H. N. SCHWARTZ Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Gregory T. Shannon, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
