Citation Nr: 20041609 Decision Date: 06/18/20 Archive Date: 06/18/20 DOCKET NO. 15-10 906 DATE: June 18, 2020 REMANDED Entitlement to service connection for residuals of right foot injury (right foot condition) is remanded. REASONS FOR REMAND The Veteran served on active duty in the U.S. Army from July 1972 to June 1975. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from a May 2011 rating decision from the Department of Veterans Affairs (VA) Regional Office (RO). Entitlement to service connection for residuals of right foot injury is remanded. The Veteran contends that his right foot condition was incurred or caused by his active duty service in Alaska and has been continuous since service. Specifically, the Veteran states that his hyperkeratosis, hammer toes, neuropathy and onychomycosis are related to his service. See VA 21-4138 Statement in Support of Claim received 7/19/2011. The Board finds that a remand for an addendum medical opinion is warranted. See Stegall v. West, 11 Vet. App. 268, 271 (1998) (holding that a remand by the Board confers on claimants, as a matter of law, the right to substantial compliance with the remand orders). In the Board’s July 2018 decision, it remanded the Veteran’s right foot claim for an examination under McLendon. That decision cited the Veteran’s STRs wherein he was treated for right foot condition and had callus tissue removed. See STR-Medical received 2/06/2009 at page 48. It further pointed to a current treatment note that referenced a painful corn on the Veteran’s right foot. See Remand BVA received 7/06/2018 at page 11; see also Capri received 9/09/2014 at pages 46, 54 and 79. Additionally, the remand directives mentioned that the examiner is asked to “identify all pathology of the right foot. Is any pathology related to service, to include the claimed corn?” Id. at page 11. In June 2019 medical opinion, the examiner found that “it was less likely than not that the Veteran has a diagnosis of Raynaud’s of the right foot”. See C&P Exam received 6/28/2019 at page 1. The opinion did not address the Veteran’s claimed right foot conditions, nor the specific directive asked by the Board. Accordingly, a remand for an addendum opinion is warranted. This matter is are REMANDED for the following action: Obtain an addendum opinion from an appropriate clinician regarding whether any diagnosed right foot condition, to include the Veteran’s corn, referenced above is at least as likely as not related to his claimed in service right foot condition, proximately due to a service-connected disability, or aggravated beyond its natural progression by service-connected disability. In doing so, please: 1) Identify all pathology of the right foot; and 2) answer whether any pathology is related to service, to include a claimed corn? A comprehensive rationale for all opinions is to be provided. All pertinent evidence, including both lay and medical, should be considered. If an opinion cannot be given without resorting to speculation, the examiner should explain why and state whether the need to speculate is due to a deficiency in the state of general medical knowledge (no one could respond given medical science and the known facts), the record (additional facts are required), or the examiner (does not have the knowledge or training). Paul Sorisio Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board S. Dixon, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
