Citation Nr: 20042610 Decision Date: 06/24/20 Archive Date: 06/24/20 DOCKET NO. 14-10 925 DATE: June 24, 2020 REMANDED A disability rating in excess of 60 percent for deep vein thrombosis of the right leg is remanded. REASONS FOR REMAND The Veteran served honorably in the United States Army from 1985 to 1987. These matters come to the Board of Veterans’ Appeals (Board) on appeal from rating decisions of a Department of Veterans Affairs (VA) Regional Office (RO) issued in September 2012. This appeal is being adjudicated under the legacy appellate framework. The Veteran testified at a personal hearing before the Board in August 2018, and a transcript of the hearing is of record. The increased rating claims was previously before the Board, and, in May 2019, the Board remanded this matter for further development. 1. A disability rating in excess of 60 percent for deep vein thrombosis of the right leg is remanded. At issue is whether the Veteran is entitled to a disability rating in excess of 60 percent for deep vein thrombosis of the right leg. The Veteran last underwent a VA examination evaluating the severity of his disability in January 2020. In May 2020 written statement, the Veteran alleged that since his most recent VA examination he had begun to manifest massive board like edema. This suggests that the Veteran’s disability rating had increased in severity, because massive board like edema is a symptom that is more severe than his current disability rating of 60 percent would suggest; as massive board like edema is a symptom associated with a total disability rating. 38 C.F.R. § 4.104, Diagnostic Code 7121. Once VA undertakes the effort to provide the Veteran with an examination, it must provide the Veteran with an adequate one, and an adequate examination is sufficiently detailed in order to ensure that VA’s evaluation of the Veteran’s claim is fully formed. Barr v. Nicholson, 21 Vet. App. 303 (2007). Therefore, this matter must be remanded in order to provide the Veteran with a VA examination. The matters are REMANDED for the following action: 1. Arrange to provide the Veteran with a VA examination evaluating the current severity of the Veteran’s deep vein thrombosis of the right leg. The examiner should explicitly discuss whether or not the Veteran does or does not have massive board like edema and explain why. DAVID L. WIGHT Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board David R. Seaton, Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
