Citation Nr: 20042801 Decision Date: 06/24/20 Archive Date: 06/24/20 DOCKET NO. 13-12 596 DATE: June 24, 2020 REMANDED The application to reopen a claim of service connection for back disability is remanded. Entitlement to a total disability rating based on individual unemployability (TDIU) due to service-connected disabilities is remanded. REASONS FOR REMAND The Veteran served on active duty from May 1972 to April 1975. These matters initially came before the Board of Veterans’ Appeals (Board) from a May 2011 rating decision. An informal hearing conference with a Decision Review Officer (DRO) was conducted in April 2015 and a report of that conference has been associated with the Veteran’s claims file. The Veteran testified before the undersigned Veterans Law Judge (VLJ) at a June 2018 hearing and a transcript of the hearing has been associated with his claims file. In July 2018, the Board remanded these matters for further development. The application to reopen a claim of service connection for back disability and entitlement to a TDIU due to service-connected disabilities are remanded. In the July 2018 remand, the Board instructed the agency of original jurisdiction (AOJ) to, among other things, obtain all outstanding VA treatment records from the VA Medical Center (VAMC) in Houston, Texas for the period since March 2015 (among other periods). Pursuant to the Board’s remand, the AOJ obtained some of the requested VA treatment records, but the recent records from the VAMC in Houston, Texas that were obtained are only dated from January 2019 to March 2020. It does not appear that the AOJ obtained all outstanding VA treatment records during the period from March 2015 to January 2019. Hence, another remand of the issues on appeal is required for completion of the development requested in the January 2018 remand. Stegall v. West, 11 Vet. App. 268, 271 (1998). If the Board is in error that the treatment records from the VAMC in Houston, Texas dated from March 2015 to January 2019 are not in the claims file, it apologizes, and requests that the AOJ indicate the location of such records in a memorandum to the file. The matters are REMANDED for the following action: 1. Obtain the Veteran’s outstanding VA treatment records from the Houston Vista electronic records system for the periods from March 2015 through January 2019 and since March 2020; and all such relevant records from any other sufficiently identified VA facility. (CONTINUED ON NEXT PAGE) 2. If the Board is in error that the treatment records from the VAMC in Houston, Texas for the period from March 2015 to January 2019 are not in the claims file, it apologizes, and requests that the AOJ indicate the location of the records in a memorandum to the file. Jonathan Hager Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board B. Elwood, Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
