Citation Nr: 20043349 Decision Date: 06/26/20 Archive Date: 06/26/20 DOCKET NO. 19-30 058 DATE: June 26, 2020 REMANDED Entitlement to a total disability rating based on individual unemployability due to service-connected disabilities (TDIU) is remanded. REASONS FOR REMAND The Veteran served on active service from July 1964 to July 1966, and from September 1966 to December 1967. 1. Entitlement to a total disability rating based on individual unemployability due to service-connected disabilities (TDIU) is remanded. The Veteran contends that a TDIU is warranted due to his service connected prostate cancer. In relation to the claim, the Veteran was scheduled and attended a VA examination in July 2019. In a November 2019 correspondence, the Veteran’s attorney requested information regarding the medical training of the individuals who performed the VA medical examinations during the pendency of the appeal. VA is presumed to have properly chosen examiners who are qualified to provide competent medical evidence. However, if the Veteran wants to challenge the competency of an examiner, the Veteran may request the curriculum vitae and other information about the qualification of a medical examiner. Francway v. Wilkie, 940 F.3d 1304 (Fed. Cir., 2019). Therefore, the claim must be remanded for efforts to be made to obtain the requested information. The matters are REMANDED for the following action: Provide the Veteran with the requested curriculum vitae for Marie G. Johnston, the examiner who performed the July 2019 VA examination as requested in the November 2019 correspondence from the Veteran’s attorney. If the curriculum vitae is not provided, send correspondence to the Veteran and his attorney explaining why it cannot be provided. Tiffany Dawson Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board J .Dworkin, Counsel The Board’s decision in this case is binding only with respect to the instant matter decided.
