Citation Nr: 20044541 Decision Date: 07/02/20 Archive Date: 07/02/20 DOCKET NO. 19-33 271 DATE: July 2, 2020 REMANDED The issue of validity of debt in the amount of $2,586.91 due to reduction in Department of Veterans Affairs (VA) disability compensation for concurrent receipt of military service drill pay for Fiscal Year (FY) 2016 is remanded. REASONS FOR REMAND The Veteran served during the Gulf War era on active duty from May 2003 to May 2004, from May 2007 to October 2007, and from October 2007 to November 2008. Although the Board sincerely regrets the additional delay, a remand is necessary to ensure that there is a complete and accurate record upon which to decide the Veteran’s claim so that every possible consideration is afforded. In a May 2017 notice, the Veteran was informed that based on his Social Security number, the Defense Manpower Data Center indicated that he received training pay as a reservist or guardsman for 51 days during FY 2016. The Veteran responded in June 2017, asserting that he attended training for 31 days during FY 2016. The Veteran’s benefits were subsequently adjusted in August 2017, resulting in a debt of $2,586.91. The Veteran filed a Notice of Disagreement in September 2017, asserting that he was paid for 22 days of drill pay, that he did not attend annual training of 21 days, and that he was excused from three drills totaling 8 days. The Board notes that the record contains no independently verifiable documentation of the number of days of training attended by the Veteran or the amount of drill pay received in FY 2016. In light of the Veteran’s consistent contention that the FY 2016 drill pay calculation is incorrect, a remand is necessary. The matters are REMANDED for the following action: Associate with the file any documentation upon which the RO determined the number of training days and the amount of drill pay the Veteran received during FY 2016. Provide the Veteran and his representative copies of any documentation associated with the file. TANYA SMITH Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board T.
