Citation Nr: 20048835 Decision Date: 07/22/20 Archive Date: 07/22/20 DOCKET NO. 15-14 793 DATE: July 22, 2020 REMANDED Entitlement to service connection for peripheral neuropathy, to include as due to exposure to contained water at Camp Lejeune is remanded. REASONS FOR REMAND The Veteran served on active duty from August 1958 to August 1962, including service at Camp Lejeune. Entitlement to service connection for peripheral neuropathy, to include as due to exposure to contained water at Camp Lejeune is remanded. The Veteran contends that his neuropathy was caused by his exposure to contaminated water while stationed at Camp Lejeune. The Board is unable to make a fully informed decision because the February 2019 and April 2019 VA examinations did not substantially comply with the Board’s November 2018 remand directives in addressing whether they reviewed documents submitted by the Veteran pertaining to toxins that cause neuropathy. The claim must be remanded for an addendum opinion. Stegall v. West, 11 Vet. App. 268 (1998). The matters are REMANDED for the following action: Obtain a supplemental VA medical opinion from the April 2019 VA examiner (or another qualified VA examiner, if the April 2019 VA examiner is unavailable) regarding whether the Veteran’s peripheral polyneuropathy is at least as likely as not related to his active service, to include as due to the contaminated water at Camp Lejeune. The claims file should be made available to and reviewed by the examiner. The examiner must consider and discuss the articles submitted by the Veteran discussing the relationship between toxins and neuropathy with a file receipt date of October 26, 2012. If the examiner determines an opinion cannot be provided without an examination, then one should be scheduled, to include any necessary testing the examiner determines is necessary. If the examiner determines that an opinion cannot be provided without an examination, (or telehealth interview, review of the record, etc., if an in-person examination is not feasible) one should be scheduled. Perkins, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
