Citation Nr: 20048871 Decision Date: 07/22/20 Archive Date: 07/22/20 DOCKET NO. 17-51 130 DATE: July 22, 2020 ORDER Service connection for lumbar spondylosis, having been withdrawn, is dismissed. A total disability rating based on individual unemployability due to service-connected disabilities (TDIU) for the period prior to April 13, 2015, having been withdrawn, is dismissed. FINDINGS OF FACT 1. In written correspondence received June 2020 and July 2020, before a Board decision was issued, the Veteran withdrew the appeal for service connection for lumbar spondylosis. 2. In written correspondence received June 2020 and July 2020, before a Board decision was issued, the Veteran withdrew the appeal for TDIU for the period prior to April 13, 2015. CONCLUSIONS OF LAW 1. The criteria for dismissal of service connection lumbar spondylosis have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. 2. The criteria for dismissal of TDIU prior to April 13, 2015 have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Veteran, who is the Appellant, served on active duty from December 1984 to April 1991. This matter comes before the Board of Veterans’ Appeals (Board) on appeal from August 2015 and June 2016 rating decisions from the Regional Office (RO), which, in pertinent part, denied service connection for lumbar spondylosis and TDIU. This case was previously before the Board in April 2019, where the issues on appeal were remanded to obtain a VA examination and medical opinion. While cognizant of its responsibilities under Stegall v. West, 11 Vet. App. 268 (1998), as the issues on appeal have been withdrawn, the Board need not address remand compliance. Dismissed 1. Service Connection for Lumbar Spondylosis 2. TDIU prior to April 13, 2015 Under 38 U.S.C. § 7105, the Board may dismiss any appeal that fails to allege specific error of fact or law in the determination being appealed. A substantive appeal may be withdrawn in writing or on record at a hearing at any time before the Board promulgates a decision. Withdrawal may be made by a veteran or by his or her authorized representative. 38 C.F.R. § 20.205. In written Correspondence received June 2020 and July 2020, prior to the promulgation of a decision by the Board, the Veteran indicated that he was withdrawing the appeals for service connection for lumbar spondylosis and TDIU. The Veteran specifically wrote that he is withdrawing the appeal for TDIU prior to April 13, 2015 and service connection for lumbar. As such, there remains no allegation of errors of fact or law for appellate consideration regarding the issues of service connection for lumbar spondylosis and TDIU prior to April 13, 2015. Accordingly, given this action, the Board does not have jurisdiction to review the appeals further with respect to these issues, and they will be dismissed. J. PARKER Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board S. Moore The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
