Citation Nr: 20060950 Decision Date: 09/16/20 Archive Date: 09/16/20 DOCKET NO. 13-16 201 DATE: September 16, 2020 ORDER The claims for an increased rating for a right ankle condition and for entitlement to special monthly compensation based on aid and attendance (SMC-AA) are dismissed. FINDING OF FACT Through a letter dated June 25, 2020, the Veteran, through his representative at the time, requested to withdraw all his pending appeals. CONCLUSION OF LAW The criteria for withdrawal of the claims for an increased evaluation for a right ankle condition and for entitlement to SMC-AA by the Veteran, through his then-authorized representative, have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served on active duty in the U.S. Army from June 1977 to August 1983. The Veteran’s claim for SMC-AA was most recently before the Board in August 2018 wherein it was remanded, along with the issue of entitlement to a total disability rating based upon unemployability (TDIU), so that entitlement could be addressed by the agency of original jurisdiction (AOJ). In a separate appeal, the Veteran appealed his claim for an increased rating for his right ankle to the Board. The Board notes that a separate Board decision was issued in September 2020 noting that the Veteran’s “appeal is dismissed.” For the purposes of clarity, there were four total issues pending at the time of the June 25, 2020 letter requesting to withdraw the claims: the issues addressed in this decision and entitlement to increased ratings for a right-hand injury and a scar of the right hand. The September 2020 decision addressed the dismissal of the issues of entitlement to increased ratings for a right-hand injury and a scar of the right hand. Dismissal 1. Evaluation of right ankle condition currently evaluated as 10 percent disabling. 2. Entitlement to special monthly compensation based on aid and attendance. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38C.F.R. §20.205. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 20.205. In the present case, the appellant, through his then authorized representative, requested to withdraw his appeal through a letter dated June 25, 2020. Withdrawals are effective when they are received at the Board. 38 C.F.R. § 20.205(b)(3). Hence, there remain no allegations of errors of fact or law for appellate consideration. The Board notes that subsequently, the agent withdrew his representation. Therefore, the Veteran does not have a representative at this time. As the Board does not have jurisdiction to review the appeal, it is dismissed. Bethany L. Buck Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board I. M.
