Citation Nr: 21001705 Decision Date: 01/11/21 Archive Date: 01/11/21 DOCKET NO. 14-15 649 DATE: January 11, 2021 ORDER The appeal is dismissed. FINDINGS OF FACT 1. The September 2019 Board issuance had remanded claims of service connection for low back disability, left knee disability including due to undiagnosed illness, and left shoulder disability. 2. The August 2020 VA Regional Office (RO) rating decision later granted claims of service connection for left shoulder disability and lumbosacral strain. There was still to consider the claim for the left knee condition. 3. On December 9, 2020, the Veteran contacted the RO requesting withdrawal of appeal on the claim for service connection for a left knee disability including due to undiagnosed illness. CONCLUSION OF LAW The criteria for withdrawal of an appeal by the appellant (or his or her authorized representative) have been met. 38 U.S.C. § 7105 (2012); 38 C.F.R. § 19.55 (2019). REASONS AND BASES FOR FINDINGS AND CONCLUSION The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 19.55. Withdrawal may be made by the appellant or by his or her authorized representative. 38 C.F.R. § 19.55. In the present case, the Veteran withdrew this appeal in December 2020 and, hence, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal and it is dismissed. D. Martz Ames Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board J. Lyons, Counsel The Board’s decision in this case is binding only with respect to the instant matter decided.
