Citation Nr: 21001738 Decision Date: 01/11/21 Archive Date: 01/11/21 DOCKET NO. 16-24 551 DATE: January 11, 2021 REMANDED Entitlement to service connection for left patellofemoral pain syndrome is remanded. Entitlement to service connection for right patellofemoral pain syndrome is remanded. REASONS FOR REMAND The Veteran served on active duty from October 1997 to August 2000 This appeal is before the Board of Veterans’ Appeals (Board) from January 2016 rating decision of the Department of Veterans Affairs (VA) Regional Office (RO) in ST. Paul, Minnesota. In November 2019, the Veteran testified at a Board hearing before the undersigned Veterans Law Judge (VLJ). A transcript is included in the claims file. The Veteran seeks to establish service connection for bilateral knee disabilities. He points out that since service his knees has been hurting from jumping out of planes as an ARMY paratrooper. Unfortunately, remand is necessary to allow the agency of original jurisdiction (AOJ) to review evidence submitted since the most recent statement of the case. A statement of the case on the Veteran’s claims was issued in April 2016, and no supplemental statement of the case has been issued since. In the nearly four years since that time, evidence has been added to the claims file, including VA treatment records relevant to the issues on appeal. In October 2020, the Board sent a solicitation letter to inquire as to whether the Veteran wished to waive regional review of the new evidence. After forty-five days, no response has been received from the representative. As such, the Board must remand the appeal so that a supplemental statement of the case may be issued. 38 C.F.R. § 20.1304(c). The matters are REMANDED for the following action: Readjudicate the appeal on the record, to include all evidence received since April 2016. If the benefit sought remains denied, provide an additional supplemental statement of the case to the Veteran and his representative, and return the appeal to the Board. JONATHAN B. KRAMER Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Javier Peluyera, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
