Citation Nr: 21002736 Decision Date: 01/14/21 Archive Date: 01/14/21 DOCKET NO. 14-41 446A DATE: January 14, 2021 ORDER The claims for service connection for a back disability and sleep apnea are dismissed. FINDINGS OF FACT Prior to the promulgation of a decision in this appeal, the Board received a written notification from the Veteran requesting this appeal be withdrawn. CONCLUSIONS OF LAW The criteria for withdrawal of an appeal by the Veteran have been met. 38 U.S.C. § 7105; 38 C.F.R. § 20.205. REASONS AND BASES FOR FINDINGS AND CONCLUSIONS The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.205. Withdrawal may be made by the Veteran or by his authorized representative. 38 C.F.R. § 20.205. A March 2019 Board decision remanded the claims for service connection for a back disability and sleep apnea as well as the TDIU claim. A rating decision in October 2020 granted TDIU. In November 2020, the Veteran submitted a written statement withdrawing all issues on this appeal. No allegations of errors of fact or law for appellate consideration with respect to these specific matters were raised. Accordingly, the Board does not have jurisdiction to review the appeal and it is therefore dismissed. MATTHEW W. BLACKWELDER Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board Q. Wang, Associate Counsel The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
