FINDING OF FACT The Veteran has a current diagnosis of carcinoma of the bladder (a form of bladder cancer), and the Veteran served in the Republic of Vietnam during a period that occurred between January 9, 1962 and to May 7, 1975. REASONS AND BASES FOR FINDING AND CONCLUSION The Veteran served honorably in the United States Army from January 1957 to August 1985. This matter comes to the Board of Veterans’ Appeals (Board) on appeal from a rating decision of the Department of Veterans Affairs (VA) Regional Office (RO) made in July 2017. This appeal is being adjudicated under the legacy appellate framework. The Veteran testified at a personal hearing before the Board in October 2020, and a transcript of the hearing is of record. Service connection for carcinoma of the bladder (also claimed as bladder cancer) is granted. At issue is whether the Veteran is entitled to service connection for carcinoma of the bladder. The Veteran underwent a VA examination in May 2017, and the Veteran was diagnosed with carcinoma of the bladder (bladder cancer). The Veteran’s citation for the Army Commendation Medal indicates that the Veteran served in the Republic of Vietnam during a period of time that occurred after January 9, 1962 and prior to May 7, 1975. Thirty-eight U.S.C. § 1116(a)(1)(A) indicates that Veterans who served in the Republic of Vietnam during that time period are entitled to the presumption of service connection for all diseases listed in paragraph 38 U.S.C. § 1116(a)(2). 38 U.S.C. §§ 1116(a)(1)(A), 1116(a)(2). Recently, Congress added bladder cancer to the list of diseases in 38 U.S.C. § 1116(a)(2), and Congress failed to specify to what degree of severity bladder cancer had to manifest (e.g.10 percent or more) or in what time frame it had to manifest (e.g. within one year of presumed exposure).
