Citation Nr: 21005119 Decision Date: 01/29/21 Archive Date: 01/29/21 DOCKET NO. 14-28 219A DATE: January 29, 2021 ORDER The appeal of the claims of entitlement to service connection for right and left fingers disorders is dismissed. FINDING OF FACT In October 2020, the Veteran submitted an appeals satisfaction notice indicating that she wished to withdraw the claims for (i) service connection for a disability of the right fingers and (ii) service connection for a disability of the left fingers. CONCLUSIONS OF LAW The criteria for withdrawal of the claims of service connection for right and left fingers disorders are met. 38 U.S.C. § 7105; 38 C.F.R. § 19.55. REASONS AND BASES FOR FINDING AND CONCLUSIONS The Veteran served on active duty from October 1978 to January 2011. This case is before the Board of Veterans’ Appeals (Board) on appeal from a February 2012 Department of Veterans Affairs (VA) Regional Office (RO) rating decision. This case was previously remanded the Board in August 2018, and has been returned to the Board for further appellate review at this time. The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed. 38 U.S.C. § 7105. An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision. 38 C.F.R. § 20.204. Withdrawal may be made by the appellant or by her authorized representative. Id. In the present case, the Veteran submitted a signed appeals satisfaction notice , dated in October 2020, in which the Veteran specifically expressed her wish to withdraw “all remaining issues(s) contained in my recent Statement of the Case (SOC)/Supplemental Statement of the Case (SSOC) and ask the regional office of jurisdiction to discontinue further development actions associated with this appeal.” Here, the pertinent SSOC was issued in October 2020, addressing the Veteran’s right and left fingers disorders claims. The Board construes this withdrawal to be explicit, unambiguous, and done with a full understanding of the consequences of such action on the part of the claimant where it was not prompted by VA, it was detailed, and definitive. DeLisio v. Shinseki, 25 Vet. App. 45, 47 (2011). Hence, there remain no allegations of errors of fact or law for appellate consideration. Accordingly, the Board does not have jurisdiction to review the appeal as to those issues and the appeal is dismissed. MARTIN B. PETERS Acting Veterans Law Judge Board of Veterans’ Appeals Attorney for the Board B. KAYS HUKILL The Board’s decision in this case is binding only with respect to the instant matter decided. This decision is not precedential and does not establish VA policies or interpretations of general applicability. 38 C.F.R. § 20.1303.
