ORDER

Service connection for prostate cancer is granted.

FINDINGS OF FACT

1. The Veteran served in, Da Nang harbor, which is within the official eligible offshore waters of the Republic of Vietnam during the Vietnam War Era, meaning that he is presumed to have been exposed to herbicide agents during service.

2. The Veteran has been diagnosed with adenocarcinoma of the prostate, or prostate cancer. 

CONCLUSION OF LAW

The criteria for service connection for prostate cancer have been met. 38 U.S.C. §§ 1110, 1116, 5107; 38 C.F.R. §§ 3.102, 3.159, 3.303, 3.307, 3.309.

REASONS AND BASES FOR FINDINGS AND CONCLUSION

The Veteran served on active duty from October 1966 to November 1970.  The Veteran provided testimony at a January 27, 2021 Board hearing before the undersigned Veterans Law Judge (VLJ).  

The Veteran asserts that he developed prostate cancer as a result of his exposure to Agent Orange during his service in the Republic of Vietnam. 

The Veteran has been found to be presumed to have been exposed to herbicides in service, and has been found to have prostate cancer.  See Medical Treatment Record dated January 9, 2019.  

Accordingly, service connection is granted for prostate cancer, as due to Agent Orange exposure.
