ORDER

Entitlement to a rating higher than 70 percent for posttraumatic stress disorder (PTSD) is dismissed.

FINDING OF FACT

On September 1, 2021, prior to the promulgation of a decision in the appeal, the Board received notification from the Veteran that a withdrawal of his claim for an increased rating for PTSD was requested.

CONCLUSION OF LAW

The criteria for withdrawal of the appeal by the Veteran have been met.  38 U.S.C. § 7105; 38 C.F.R. § 19.55.

REASONS AND BASES FOR FINDING AND CONCLUSION

The Veteran had active military service from October 1965 to October 1967.

This appeal has been advanced on the Board's docket pursuant to 38 C.F.R. § 20.900(c).

Entitlement to a rating higher than 70 percent for PTSD is withdrawn

Withdrawal

The Board may dismiss any appeal which fails to allege specific error of fact or law in the determination being appealed.  38 U.S.C. § 7105.  An appeal may be withdrawn as to any or all issues involved in the appeal at any time before the Board promulgates a decision.  38 C.F.R. § 20.205.  Withdrawal may be made by the appellant or by his or her authorized representative.  Id.  

The Veteran, in a Report of General Information on September 1, 2021, requested a withdrawal of his increased rating claim for PTSD.  Previously, on February 8, 2021, the Veteran's attorney had also submitted written notification of such request for a withdrawal of the increased rating for PTSD claim.  Hence, there remain no allegations of errors of fact or law for appellate consideration.  

Accordingly, the Board does not have jurisdiction to review the issue on appeal and it is dismissed.
